Force Majeure
Neither party shall be liable for any deficiencies or delays, including cancellations or rescheduling of bookings, according to bookings made in connection with this agreement,
i) if and to the extent that such deficiency or delay is directly or indirectly caused by fire, flood, natural disaster, lockout, strikes, blockade, war, terrorism, civil unrest, cyber attack, or any other extraordinary cause beyond the reasonable control of the party, and
ii) provided that the party failing to meet its obligation, or failing to deliver as agreed, could not with customary and reasonable efforts have prevented such deficiency or delay.
An internal strike at Comwell and its subcontractors, which significantly affects Comwell's ability to conduct business, shall be considered as force majeure.
